The more i woke up and thought about the pain and nightmares; I had flashes of it being Matt doing the assaulting. I tried to find one of my friends online to talk to and no one was awake aside from a relative of mine, they told me that if i didn’t call someone they were calling campus police. I called Dr. Sawyer and told her and she took me to Stonewall. We left stonewall ER because the doctor basically told me I got what i was asking for by sharing a bed with him and told us that the Sexual Assault Nurse (SANE) would take 2 hours to make it from Clarksburg, so we left and went to UHC. They took pictures and did the exam. In the results it didnt show a lot of physical trauma because I wasn’t quite fighting back having taken very strong sleeping medicine. After that, I stayed at Dr. Sawyers house for about a week. I informed some of my professors what had happened and all of them understood except Teresa Dody. She point blank looked at me and told me I was lying. I quit going to classes and was working with Devan Heater from HOPE. I had filed for a protective order and Gerry told me I did NOT need a lawyer to go in with because “he was my lawyer”. Well I went in with Devan and she was unable to say anything. The end result of that hearing was my being denied, and Matt and his lawyer Garth Beck walking out of the room laughing and high fiving each other. Later on we went in front of CAROL WOLFE for some sort of hearing. Gerry called me to the stand and Carol Wolfe asked me to go into detail including, “What do you mean you hurt” when I said I was very sore upon waking up. All of this with Matt not even 10 feet in front of me. The responding state police officer that showed up at the hospital and took Matt’s written and verbal confession, was Magically “on vacation and not served with his subpoena” for this hearing!”

Trooper Brandon Moore was placed on administrative leave recently following the indictment of Mingo County Circuit Judge Michael Thornsbury on federal conspiracy charges. Thornsberry will sure be going to prison when all is said and done, and Judge Thornsberry was under the impression that he was immune from prosecution, and someone heard Facemire say the same thing not long ago. Don’t these dumb fucks get it, they break the law they go to jail just like everybody else, and one can only hope they go to jail and have to meet up with people they put there, and then the laws of Karma play out.
Federal prosecutors said Moore agreed to file a false grand larceny charge against a man at Thornsbury’s request, which is a similar situation Judge Richard A Facemire is being accused of concerning the, “Travesty of Justice,” case the longest running court case in Gilmer County history.
U.S. Attorney Booth Goodwin said Moore will not face charges because of the good ole boy system set up even with the feds in West Virginia, which has the highest rate of nepotism and cronyism in the entire United States. I was there when Braxton County Magistrate Carolyn Cruickshanks had a mental break down in a holding cell a few years back at Central Regional Jail – And had to be restrained in a pickle suit. She was about to be put in the same pod as women she has sent to jail. NICE! Cruickshanks helped her incarcerated son, Jordan Grubb, distribute court documents to other inmates at the Central Regional Jail about a witness in a drug case.
It was believed Cruickshanks was so depressed after she was caught, prosecuted and locked up, as to bring harm to herself. What they put that woman through that night was absolute torture. In WV they feel they can torture you if you are not well liked by certain judges. This may sound outrageous, but I have experienced this for myself and witnessed it with my own eyes. The “Powers that Be,” didn’t want to arrest Cruickshank’s, they wanted to destroy her!!
I witnessed her terror and her torture while all bundled up in a pickle suit, like she was some strange character in a child’s nightmare, during the witching hour in retaliation for the delivered sealed package from her boys lawyer to the jail, letting her son know who snitched him out on a dope deal that got him busted. Records show very early in his legal career, Gerry Hough was scolded by the Lawyer Disciplinary Board for violating federal law when he improperly accessed a Glenville State College student’s academic records in the course of representing her accused attacker in a sexual assault case.
The Board on December 09, 2000, filed a one-count statement of charges against Hough for committing three violations of the Rules of Professional Conduct when he asked for, and received, a copy of Anita Phillips-Wiseman‘s transcripts on November 13, 1998. At the time, Hough was representing Wilkie Perez, a GSC student and quarterback of the football team, on charges he raped Phillips-Wiseman.
In the statement, which acts as an indictment for disciplinary purposes, the Board stated that Hough was also a member of the GSC faculty at the time he was representing Perez. Hough, the statement alleged, used his position on the faculty to mislead the GSC Registrar’s Office into getting a copy of Phillips-Wiseman’s transcripts for the sole purpose of aiding in Perez’s defense.
Under the Family Educational Rights and Privacy Act, strict limits are placed on disclosure of a student’s academic records, and who has access to them. Among those who are permitted access to a college student’s records, including his or her transcripts, is the student’s advisor.
According to the statement, at the time he requested her transcripts, Hough was not Phillips-Wiseman’s advisor. Because of that, the Board charged Hough with violating Rules dealing with truthfulness in statements to others, respect for the rights of third persons and misconduct.
Eventually, the Board on August 04, 2004, opted to dismiss the charge, and “caution” Hough, who by this time had become Gilmer County’s prosecutor, for his conduct, and fine him $400. The reason for the Board’s decision was due to the fact that at the time of the incident, Hough had been a member of the state Bar for only a month, and, upon learning of his actions, Thomas Powell, GSC’s then-president, reprimanded Hough, and denied him a pay raise given to other GSC faculty and staff.
As part of the agreement to dismiss the charges, Hough, despite his initial denial, had to admit to them, and express remorse for his actions.
Records show the sexual assault charges against Perez were dismissed.

Clay County sheriff Miles Slack will appear in federal court on Sept. 17, but before that happens he will likely resign.
Slack is charged with hacking his former wife’s work computer in a Clay magistrate office, a computer under the jurisdiction of the WV Supreme Court.
“It will be hard to replace him but I’m glad that we have some people that are qualified,” said Mike Pierson, president of the Clay County Commission.
Prosecutors say Slack secretly installed a keystroke logger on the secure computer, a federal offense.
The commission has received 16 applications for the job.
“We are looking for law enforcement experience. We’re looking for someone that could get along with the people, that could pick up and step in,” said Pierson.
Despite his offense, local officials say Slack is still highly regarded in the community.
In the 2012 Democrat primaries, Slack won nearly 78 percent of the vote. In the general election, he ran unopposed.
Under state law, the commission has 30 days once Slack resigns to fill the vacancy. Commissioners said they will narrow down the list, conduct interviews and then choose the new sheriff.
Slack’s replacement will serve until Nov. 2014 when the post is up for re-election.

GERRY HOUGH IS CRAZY according to one of West Virginia’s top lawyers that was asked about bringing action against Gerry and Judge Facemire and few others like Sheriff Gerwig involved in a criminal conspiracy, but first I guess charges have to be brought before we can seek the money we want in civil damages compensatory and punitive. Can’t name the attorney, but he has won some big civil rights cases in WV.

CLARKSBURG – A former Glenville State College student is alleging campus police failed to properly investigate her claim she was raped two years ago following an impromptu party in her dormitory.
The College, and Daniel Bell, chief of its public safety department, are named as co-defendants in a civil rights suit filed by Amanda Smith. In her complaint filed Sept. 17 in U.S. District Court, Smith, 21, of Mineral Wells, says campus police not only failed to conduct the most routine of investigation into her allegation she was sexually assaulted by a fellow student in 2010, but also lost important evidence.
Additionally, Smith alleges hers is not the first time either campus police or GSC officials have showed deliberate indifference toward alleged rape victims.
A not-so-quiet evening
According to her suit, Smith, then a sophomore, after returning to her room in Goodwin Hall from her on-campus job on Sept. 18, 2010, received a text message from Michael McHenry, a fellow student, asking if she wanted to go out for ice cream. About that same time, Jayde Layne, another student, knocked on Smith’s door requesting help in the dorm’s laundry room.
However, Layne agreed to join Smith and McHenry for ice cream. They were accompanied by Jordan “Opie” Watkins, Erietta Patrianakos, and several “unidentified students.”
After returning to Goodwin Hall between 5:30 and 6 p.m., Smith alleges Layne, and another student, Kala Fisher, asked if she would get McHenry to buy them alcohol. When Smith declined, Fisher and Layne then asked Patrianakos who agreed.
According to the suit, Patrianakos then took the alcohol to Watkins’ room, and left to be with her boyfriend. Shortly thereafter, Smith joined other students including Layne in Watkins’ room.
About 8:30 p.m., Smith says she left to help her roommate carry groceries to their room on the second floor. Upon returning to Watkins’ room, Smith found additional students present including “unknown black males mixing drinks.”
Later around 9 p.m. Smith says Layne, who’d previously been mixing drinks in the bathroom, offered her a plastic cup. After consuming the unspecified contents of half of it, Layne brought her a different cup.
Sometime between then and 10 p.m., the suit maintains Smith appeared she was having a “mild seizure” after becoming nauseous “with alternating bouts of vomiting and urinating, crying and screaming.” Sometime thereafter she became unconscious.
According to the suit, someone removed Smith’s clothes leaving her in only her bra and panties. Upon discovering her disrobed and unconscious, Layne, Patrianakos and Fisher put Smith in the shower.
Sometime after 10 p.m., Andrew Lewis, Goodwin Hall’s resident director, heard Smith screaming, and went to Watkins’ room to investigate. After arriving, he was joined by Travis Nesbitt, a student in an adjoining room, in rending first aid to Smith.
At 10:09 p.m., Lewis called campus police requesting medical assistance for Smith. Twelve minutes later, Officer William Boone called for an ambulance.
An ambulance arrived at an unspecified time to take Smith to Stonewall Jackson Memorial Hospital in Weston. According to the suit, Nesbitt accompanied Smith, and observed her “holding her hands between her legs, stating “‘it hurts.’”
Upon arrival at SJMH, Smith was placed in the intensive care unit. An initial examination of Smith discovered “a bodily fluid ‘pouring out’ of [her] vagina that ‘was not supposed to be there together with bruising on [her] thigh and arm.”
A toxicology report revealed Smith had a blood alcohol content of .236, and the presence of benzodiazepine in her system. In her suit, Smith avers she was not taking any medication containing benzodiazepine, and only consumed half of the drink Layne gave her.
Because she did not regain full consciousness until sometime the next morning, a sexual assault examination was performed in Smith later that afternoon. The examination revealed, among other things, bruising on Smith’s left shin, knee, upper arm and hip.
Also, the examination discovered Smith had “a large amount of mucus/discharge from her vagina that was ‘white/yellow’ in color in spite of the negative findings of vaginitas and the appearance of bacteria in her vagina opening.” Furthermore, a nurse told Smith’s mother “‘This should not be there,’” when showing her a swab of the substance removed from Smith’s vagina.
Evidence lost
The suit accuses GSC officials, specifically Bell, of “failing to follow protocol routine in sexual assault cases.” This includes the “lack of safeguarding and storing of evidence [and] properly securing a crime scene.”
According to the suit, campus police failed to collect both the bed sheets in Watkins’ room and the clothes he used to dress Smith after she threw-up on herself before they were laundered. Also, the cups used to mix and serve the drinks were destroyed before they could be collected.
Additionally, the suit alleges an investigatory notebook kept by Bell was “accidently placed in a washing machine and destroyed.” Furthermore, Bell “showed minimal training” when he accused Smith of “placing the bruises found on her body herself.”
According to the suit, the inability of campus police to timely collect evidence was a result of no certified law enforcement officer being on duty at the time Lewis called them for help. The investigation did not begin until Glenville Police Sgt. Casey Jones arrived at a time not specified.
Any investigation into who might have raped Smith was hindered by Layne, Watkins, Patrianakos and Fisher refusing to cooperate with police. According to the suit, they “have refused to identify students in the room and have changed their statements.”
Following her alleged attack, Smith says she attempted to complete her classes that semester. However, due to harassment by Layne, Fisher, Watkins, Patrianakos and other students, who are named as co-defendants in the suit, Smith says she found not only attending classes, but also living in Goodwin Hall difficult.
Assurances college administrators made to “implement reasonable accommodations” for her to finish her classes, Smith said, where not kept. After receiving a letter dated Oct. 7, 2010 from the College’s provost that she would most likely receive failing grades in her classes, Smith decided to withdraw.
According to her suit, college officials continued to display insensitivity toward her after she withdrew. Bell, Lewis and Jerry Burkhammer II, the dean of student affairs, were all no-shows for a meeting with Smith and her parents when she returned to campus to retrieve some personal belongings from her dorm room.
In the two years since she was attacked, Smith says there have been other sexual assaults take place on campus. Though she does not provide specifics, Smith says due to “a lack of investigatory technique and result” similar to what happened in her case, the other women “are considering filing separate claims against [GSC].”
As a result of her attack, the failure of campus police to properly investigate it and the harassment she received afterwards, Smith alleges she’s suffered “severe and permanent psychological damage, emotional distress and decreased educational opportunities.” Along with ones for civil rights violations, she makes claims for failure to train, retaliation, assault and battery and intentional infliction of emotional distress.
Smith seeks unspecified damages, interest, court costs and attorneys fees. She is representing herself.
The case is assigned to Judge Irene M. Keeley.

Obviously from facts even the state police accepted as true and accurate which proved Gerry Hough to be guilty of a SERIOUS crime of subornation of perjury — Gerry is getting hauled into court – a retired major for the State Police may be brought in as a witness who said, HOUGH was guilty of Subornation of perjury, but was protected by the only three statute of limitation in all of the state code, but we found out we were tricked by Major Ingold the former department head of Police Standards — for he was referring to a misdemeanor, but Hough we found to be guilty of a felony — since he paid cash money to a state witness to LIE about property that they did not own.
The Gilmer County Commission should pay the damages and are just as guilty, but unless they all meet with a bad end by some miracle we are stuck with these criminals that hold public office, unless we all sign petitions to remove them from office.
The penalty for that crime of perjury of which HOUGH is guilty according to State Code, is that, if he is eventually found guilty in a federal or state court the guilty party can NEVER hold a public office again.
Finally it was proven to the police and Gilmer County that Gerry Hough truly is guilty of something awful! PAYING a state witness to LIE under oath is an awful and an evil deed.
Hough should no longer be allowed to serve as prosecutor of Gilmer County and if the County Commission does nothing, they should all be removed from their positions immediately. 667 petitions for removal should be filed on the County Commissioners and Gerald B Hough immediately, if we post them on the internet, we are hoping to start getting the signatures we need to remove these Anti- American politicians.

One of the talks was on environmental terrorism. It was learned that a group of “greenies” plan to demonstrate all the way from Pittsburgh to Point Pleasant. Not so long back they created a problem at the Triad Hunter Green facility at New Matamoras. The demonstrators linked themselves together with “sleeping dragons” that must be cut off with specialized tools which the Washington County Sheriff’s office now possesses. It seems these folks have sophisticated photography and they want folks to hurt them so that they can sue and get sympathy.
It was announced that CNX/Consol has divided up their Marcellus acreage with Noble which initially had 50% of it all. CNX will take the dry gas while Noble will develop the wet areas which include Wirt County & environs. A similar deal has been worked out with Hess which has the Utica rights.
One of the main fellows at Artex which is based near Marietta gave a report on the Utica in Ohio and showed the oil, wet & dry windows. The dry wells come in at as much as 3 million cubic feet/day with the went ones at about 1/3rd of that. However, if the well makes 800 bbl/day of gas liquids @ $45/bbl with condensate fetching $80 or more/bbl, then the wells become lucrative. It was noted that “Washington County [Ohio] is worthless” but the speaker made it very clear that such was not at all the case. If one extended the lines southward across the Ohio River part of Pleasants, all of Wood and most of Wirt Counties are in the Wet Utica zone.
It was noted that the liquids will be removed from the gas in a two stage process — first just removing the heavier compounds from the methane and then separation in one of the big fractionation plants like Hastings in Wetzel County. Then the ethane will be sent, via the ATEX pipeline to ethane crackers in the Gulf of Mexico with the propane being taken away by the TEPPCO pipeline. It was noted that there is now or soon will be 116 million cubic feet/day of fractionation capacity. It was noted that $billions have already been invested in infrastructure with, obviously, much more on the way.
Larry Cavallo noted that the lateral length for Marcellus wells (average) has gone from 3,853 feet to 7,173 feet & that if one first fractures the Burkett formation one gets better results from the Marcellus fracs. He noted that the yield from wet wells worked out to 1/2 bbl of oil equivalent/day for foot of lateral. Also the length of frac stages has gone from 500 feet to 150 feet.
The price of local Pennsylvania grade crude dipped to $106.91/bbl. while ALS (drip) fetched $86.19 with Marcellus & Utica light was $102.99 and medium fetched $108.41.
There will be a fall farm tour in Monongalia County on October 5. Participants should be at the Park & Ride at the junction of I-79 & I-46 (the road to Cumberland) at 9 A. M.

The Commonwealth of Virginia has determined that CBM (coal bed methane) is a mineral estate separate from the coal in which it is contained. There is now a class action lawsuit in the Old Dominion by mineral owners trying to get paid the royalties that have been put “in escrow” for up to 25 years. The main defendants are EQT (Equitable) and CNX (Consol Energy). Federal Judge James Jones is to rule soon on the case.

Ohio law enforcement determined that members of the Gilmer County offices committed a crime, and according to Judge Spicers office (who is now since retired) said that whoever hid the deed, then sold the property and gave the money to some friends of theirs should go to prison, and the matter may have violated federal law.
This all has to do with the criminal conspiracy committed by Judge Richard A Facemire, Gerald B Hough prosecutor who brought false charges and committed subornation of perjury — Mickey Metz — and Sheriff Larry Gerwig who lied on the stand about ownership and value of property during the longest running court case in Gilmer County history known as the “Travesty of Justice,” case.
A judge ordered property sold so that Ruth Woofter could get the medicaid operation she needed while being a property owner and was in need of an immediate operation. A lawyer named Hernstein did the work, but Beverly Marks (BM) blocked the sale and Ruth Woofter died and never received the operation. The proceeds from the property were then distributed among several friends of Beverly Marks that had no contact with Ruth Woofter in over 30 years, and too non-relatives. How many other criminals from Gilmer County were involved in this?
Rosa Belle Gainer- Cunningham received 6,000 dollars and her son Jack received 1800 dollars and neither one of them were related to Ruth Woofter. This crime was sanctioned by the Butcher and Butcher law firm who may be held responsible for breaking several laws, including theft of property.
UPDATE – The Clay County commission Monday has appointed an interim sheriff, the current sheriff Miles Slack having resigned from his post amid a federal investigation.
The commissioners have appointed Reva Schoonover, currently chief tax deputy, as the temporary sheriff, who will serve about 30 days will until a permanent sheriff is named until the next election cycle.
The commission told media they have 16 candidates for sheriff, saying they will narrow the list down and begin interviews with the person being named later this month.
UPDATE – Clay County Sheriff Miles Slack has presented his resignation.
The Clay Commission will hold a special meeting Monday to appoint a replacement.
I live in Glenville and know how this town is all too well. I really hope Fred’s family keeps up on the local ghost media, they are the only ones getting out and talking to people and really investigating things, because unfortunately local law enforcement won’t be any help when it come to a murder case. I have seen it time and time again, the non-investigation special investigation well just go on forever – performed by the man who lied to us when he was only an attorney for three weeks and that is Ferpa Violator Gerry Hough Gilmer County Prosecutor.
Glenville will make the murder case go away, out of sight! Nobody wants their kids going to school at a place where this kind of stuff happens. I was always afraid in Calhoun County, after reading all the stuff that happens there, but now I see Gilmer County is much worse and truly crooked, just as has been said all along!
The people referred to as the ‘Powers that Be’ are afraid the murder of Fred Hill will ruin the towns name.
Hell, the towns name was ruined long ago thanks to the Butcher and Butcher law firm stealing all that money from the AJ Woofter estate and then having their employee Rosa Belle Gainer Cunningham profit from the criminal act when courthouse employee’s illegally pulled the deed to some of the estate property. And then, even though Rosa Belle Gainer was not a relative and there is documentation posted on the internet to back up that fact, she gets a huge amount of cash from an illegal action born in the Gilmer County Courthouse and executed with no conscience by Beverly Marks former County Commission Clerk.
Instead of squirrel season starting early, maybe we should make it open season on the courthouse thieves and have no top-end limit, because until then all you are going to have are the same old criminals running things around here.
Glenville has turned into a dangerous and scary place. I am even afraid to make a wrong step or say the wrong thing here. It is much more evil than you know.
You really can get away with murder here. Just look at the Willard Cottrill case, where the FBI finally had to be notified about the illegal actions of Sheriff Gerwig.
The court system, judges, town officials, they seem to be able to do what they want here, and control everyone with “What they could do to them,” OR what they could do to their children.
Glenville has turned out to be an awful place and I am sorry for the day I ever thought of moving here. Now I am sort of stuck, because if you are poor anyway, pretty soon if you live here long they even have a monopoly on the food supply.

If you are a student of sociology like I am, then you may recognize that for every unique environment, there always exists a different set of norms and mores for that individual group or community. We see this particularly in the US where people in the Deep South talk and act completely different than Los Angeles or New York residents.

In Gilmer County the elite have had a long tradition of doing a little something called, “Make Your Own Rules!” In Gilmer County and especially the County Seat at Glenville this has actually become a tradition.
If you want some history of this, sit in the office of Karen Elkin the Gilmer County Circuit Court Clerk. She has seen 30 PLUS years of crimes being committed inside the courthouse and has been under stress and strain to not say much about it, since her job and very livelihood depended on staying silent. Plus, Karen is sister to Sandy Pettit the right hand man to the lord of the Church of IKE!!
Policy broken? LAWS are broken by public officials in Gilmer County on a regular basis! And for the most part they have gotten SCOTT FREE away with it. We all know Scott Free now, and we know that dude lives in Glenville and smirks about the courthouse just about every day!

The question is, is Dianna Holmes going to have the guts to speak up in federal court and nail Gerry Hough to that bitch board.

Just ask JEAN BUTCHER already charged once with an election fraud crime, and none of them know that somebody is watching every move that is made in that estate case, taking notes and is ready to pounce on the guilty parties as soon as the signal is given and shortly after the dogs are let off their leash and given the command to do what they have been trained to do.

Buckwild star Salwa Amin is scheduled to be arraigned on a two-count indictment tomorrow Sept. 18 at 10 a.m. in Nicholas County Circuit Court in Summersville.
Salwa Amin, 24, of Charleston, was indicted on two drug charges. She was arrested in February along with two others, Shawn Booker, 42, of Detroit and Jason Jones, 31, of Summersville. They were all charged with possession with intent to distribute heroin and oxycodone and conspiracy to go Buckwild, which Senator Manchin put a stop to and now.
“Buckwild”, a show about young adults living and partying in the Charleston area, was canceled after its first season on MTV following the death of star Shain Gandee.
Senator Manchin the former governor of West Virginia was upset the show got on the air and attempted to stop production, but in other states like New York they still recognize American FREE SPEECH which is outlawed in West Virginia and the entire state and most county governments fall under totalitarian rule.
Many feel that it is pretty weird that just when the show took off its main MTV star is found dead, so killing SHAIN killed the show, which is exactly what Senator Manchin wanted.

Clay County Sheriff Miles Slack pleaded guilty to a federal charge that he hacked his wife’s work computer. Sheriff slack resigned last week.
The Clay County Commission named Reva Schoonover to serve as temporary sheriff for no more than 30 days.
Slack has officially pled guilty to a wiretapping charge in U.S. District Court in Charleston.
The man we knew as the Clay County Sheriff now faces up to five years in prison.
Sentencing is set for December 19, 2013.
The government said Slack secretly installed a keystroke logger on a computer in the Clay County Magistrate Court office in April where his wife worked. They were married at the time but have since divorced.
Spyware devices can be purchased online and typically are 1-2 inches long, about the same size as the Gilmer County Sheriff’s Larry Gerwig’s Weener — and then the small frail device is attached to the keyboard cable. Once installed, even a man with a little dick can intercept anything typed on that keyboard.
Prosecutors said Slack admitted he intended to monitor her activity, including messages she sent through email and Internet chat rooms. He also wanted to capture her log-in information for various Internet services.
Slack admitted the device captured information about court business and the personal information of defendants in magistrate court. The device was in place for more than two weeks.
Computers in the offices of circuit judges and magistrates are owned and maintained by the state Supreme Court and are connected to a central computer network.
“It’s a shame that Clay County’s chief law enforcement officer chose to illegally tap a government computer,“ said U.S. Attorney Booth Goodwin. “Our elected officials and law enforcement officers have to respect the law like everyone else. If they don’t, there are consequences.“
We are not sure, it that was a veiled message sent to former Gilmer County Sheriff Metz, or the current Sheriff, Larry Gerwig, who both have been accused of being involved in criminal conspiracy and covering up serious crimes like murder and rape.
Slack ran unopposed for sheriff last November after defeating two other contenders in the Democratic primary in May 2012, winning the nomination with nearly 78% of the vote.
Commissioners are currently reviewing 16 applications for the permanent post.
CHARLESTON –The publisher of PutnamLIVE.com and contributing member of the Secret Seven Coalition is suing the Putnam County Health Department, alleging it defamed him and had him unlawfully arrested.
Lolita Kirk was also named as a defendant in the suit.
Mark Vance Halburn is the publisher of the news website PutnamLIVE.com and a journalist whose principal place of business is in Dunbar, according to a complaint filed Aug. 23 in Kanawha Circuit Court.
Halburn was the man who asked Judge Watkins to stand and face him like a man in the hearing held by the Judicial Investigation Commission that resulted in Judge “Chip”Watkins being suspended without pay until December 31st 2016.

Halburn claims on March 18, he filed a Freedom of Information Act request with the Putnam County Health Department’s former administrator Joel M. McKinney for the purpose of reviewing financial documents dating back to January 2010.
McKinney responded with the request that Halburn make an appointment to review the records and Halburn made an appointment for April 2, according to the suit.
Halburn claims his appointment was confirmed on the morning of April 2. However, when he appeared at the office, he was arrested for trespassing and McKinney refused to allow him his legal opportunity to review and copy financial documents, the suit say.
We don’t play that Crooked County rigmarole down in Kanawha County and that kind of action will get you sued quicker than a Butcher Bitch can yank a Hot Toddy Roddy.
PCHD subsequently refused to allow Halburn to review the requested financial documents and has made no effort to furnish the documents, according to the suit.
Halburn claims by arresting him and concocting a story about him allegedly interfering with a government agency, PCHD violated his civil rights, including malicious prosecution, character assassination, defamation of character, slander, libel, false imprisonment, interfering with his business as a journalist and intentional affliction of emotional distress.
Gilmer County authorities could find themselves on the losing end of similar suit if their latest illegal schemes are exposed in time for subsequent US District court actions to take place in which Glenville State College and several criminal elements associated with the brutal rape of Amanda Smith honor student from Parkersburg hit national headlines as planned.
Halburn is seeking for the court to declare that the defendants’ refusal to disclose the records he requested is unlawful; grant injunctive relief, enjoining the defendants from fully and properly improperly withheld; grant a permanent injunction requiring the defendants to undergo training for better understanding of West Virginia Code; and a whole lotta cash in punitive damages, plus $2,000 for attorney fees incurred to fight the criminal charges.

Federal prosecutors are requesting a plea hearing for Mingo County Commissioner David Baisden, who was indicted last month on federal extortion charges.
Baisden, 66, is accused of demanding that Appalachian Tire sell him tires for his personal vehicle in 2009 at a discounted price that is available only for government vehicles.
Assistant U.S. Attorney Steve Ruby filed a motion Wednesday morning asking U.S. District Judge John Copenhaver to schedule a guilty-plea hearing in the case. Baisden’s trial had been scheduled for Oct. 21. He remains free on $10,000 bail.
Baisden has cost Appalachian Tire “tens of thousands of dollars since 2009,” U.S. Attorney Booth Goodwin previously said.
When Appalachian Tire refused Baisden’s demand for discount tires, he threatened to cut off the store’s agreement with the county, according to the federal indictment. At the time, Baisden was the purchasing agent for the County Commission, which gave him authority to choose where the county purchased tires, the indictment states.
After he was charged, Baisden stepped down as purchasing agent. The county’s two other commissioners appointed Tina Abbott, the county’s administrative assistant, to handle purchasing, and said a commissioner must approve any expenditure that exceeds $500.
Prosecutors say in the indictment that Baisden directed Jerry Colegrove, who worked for the commission, to order a set of tires for Baisden’s personal vehicle at the government price.
When Appalachian refused, the indictment states, Colegrove told Appalachian employees that Baisden, “was a powerful official and that Appalachian would risk losing its business with the Commission if it did not sell [him] tires for personal use at the Government Price,” the indictment states.
Appalachian Tire still refused.
Around June 12, 2009, the indictment states, Baisden left a voicemail message for the store’s manager threatening that commissioners would stop purchasing tires from the company if it didn’t sell him the tires at the discounted price.
The company didn’t respond to the alleged threat, according to the indictment.
In turn, the commissioner terminated Appalachian Tire’s business relationship with the commission and switched to a different tire supplier, according to the indictment.
Goodyear has a contract with the state. Appalachian Tire is a local distributor of Goodyear.
Discounts for tires for government vehicles can range from 45 percent to 52 percent, based on the tire’s size and other factors, according to Jeri Whitehead, director of purchasing for the Kanawha County Commission.
Before he was elected commissioner in 2009, Baisden was the assessor in Mingo County.

Nearly 118,000 West Virginia families could automatically qualify for Medicaid coverage.
The West Virginia Department of Health and Human Resources has mailed auto-enrollment letters this week to recipients of the state’s Supplemental Nutrition Assistance Program.
At the same time, the Republican led US House of Representatives has moved to cut “food stamps,” now called SNAP, by $4 billion over the next ten years, affecting six million people nationwide.
Eighty-five percent of those affected would be working people, seniors, disabled and children.
Currently 47.7 million people receive the food supplement.

A 14-year-old Lewis County cold case has been cracked with the arrests of three men in connection to the murder and disappearance of a mother and daughter in 1999.
The search for Mary Friend and Maxine Stalnaker extended into Calhoun when they disappeared, their bodies were never found.
The women were last seen leaving their Lewis County home in December 1999 for a Christmas shopping trip. Their car was found in Harrison County five days later.
Their purses were recovered from Stonewall Jackson Lake in 2002.
Authorities are saying that Joseph Metz, 39, is allegedly behind their murder. Metz is accused of robbing, kidnapping, and killing his own mother and grandmother.
Police say Metz didn’t carry out the crime alone and have also charged Steve Freeman and David Hughes.
Investigators say they believe Hughes ordered Metz and Freeman to kill the women because they had a tablet full of information about illegal criminal transactions involving the men and the Wilderness Plantation in Jane Lew where Hughes was the owner.

Behind closed doors “Gerry” convinced the judge to approve and give a ruling on the little known ploy known as a “Diversion,” as a trick to let off a deputy charged with seven felony’s and one misdemeanor.
A diversion is a little known “Crooked TRICK,” in which if the magically missing evidence does not show up within a year the case against a cop looking at 7 felony charges is dismissed.
HOUGH had his BOY–State Trooper Doug Starcher lose the evidence against Calhoun County Chief Deputy Bandy. Those Calhoun buddies can really stick together when they need a bridge over troubled waters.
Starcher was in charge of the evidence and then one day it could not be found–so no more case against a bad bad deputy-also Starcher had been up on two perjury charges from getting caught lying in court, so he is not the most reputable State Trooper to have on the case. Hough dismissed the charges against Starcher if he kept to his job of making sure the evidence against Bandy never made it into the court room. So you see how this all works and now getting some history on Gerry Hough Crooked County Prosecutor makes it appear to any reasonable person all we have been saying since 2005 about HOUGH’S ‘Criminal Past’ ..is true, and hell “Gerry Hough,” even had a FERPA violation five years before that, so Hough has a history of criminal misconduct, and the Bandy case is full of documentation that proves that Hough has been less than honest and truthful in the past and Gerry Hough even had to admit lying officially to the office of disciplinary counsel, over the Wilkie Perez RAPE Case at GSC!

About one hundred people gathered Saturday evening at the Jacksons Mill Baptist Church to keep the memory of Aliayah Lunsford alive and a candle light vigil is scheduled Tuesday at the Lewis County Court House from 6 p.m. to 8 p.m.
It’s been two years since three-year-old Aliayah Lunsford of Weston disappeared from the face of the earth. Aliayah was last seen September 24, 2011 in her home. Some think she was given to a rogue cps worker and sold into adoption, but others think that she is dead and met with some bad end possibly related to some bad relation of her mothers – who seems to go from man to man – having child after child – all the while being a burden to the state. Is this a sign of the times in rural America? The NSA spying on all of us, and then, the population going to hell behind drug addiction, while also depending on the state for support and food, all the while just a churnin out young ones like it was Tobacco Road or somethin, in West ‘BY GOD’ Virginia.
U.S. District Judge John Preston Bailey said Lunsford has been warned repeatedly to stay away from a convicted felon who fathered what will be her eighth child. She met the man at a halfway house in Wheeling and fa fa fucked not long after Lena Lunford received her release from prison on welfare fraud …and so it goes!

The victim attempted to call 911 when Lunsford grabbed the phone and threw it against the wall, according to the criminal complaint.
The victim was able to get away from Lunsford and enter a different room where she fell asleep, just to wake up to a good old fashioned beating and rapin in the morning!

Aliayah Lunsford was last seen September 24, 2011 in her home, her mother, Lena Lunsford, said she had checked on the toddler three hours before she went missing, but I never really believed that story anyway.
Police and volunteers unsuccessfully searched for days for any sign of the girl. Authorities have never identified a suspect.
The child’s mother Lena Lunsford was released on probation again following her third arrest for violating terms of her supervised release.
U.S. District Judge John Preston Bailey said Lunsford has been warned repeatedly to stay away from a convicted felon who fathered what will be her eighth child. She met the man at a halfway house in Wheeling after her release from prison.

Deputies in Nicholas County arrested Kelcey Nicholas, age 28, and Lataura Jarrett, age 21, both of Mt. Nebo Friday. Kelcey carries with him the presence of the Devil along with the smell of burning sulfur on his undulating daughter!

It’s been a smoke and mirrors world living in West Virginia faced with joining 21st Century technology, the need to have real high-speed broadband for the education of our children and to operate small and large businesses which depend on having adequate connectivity.
Over the years, I have attended large numbers of seminars, conferences and political events that touted the necessity of broadband to rural areas, linked with initiatives, actual funding and promises that such will be coming.
In 2013, West Virginia remains at or near the bottom in broadband connectivity or availability, but promises and press releases keep coming, with outfits allowed to sell “high-speed” or “broadband” services under the guise that it is the real thing.
If the Hur Herald was a real business, we would have pulled the plug years ago.
Not only has broadband access been affected by those in charge of millions of dollars in the Mountain State, it has also affected the development of a communications infrastructure for the safety and security of the state’s citizens.
The Hur Herald’s persistent pursuit of the issue, often with the leadership of Frontier, has at the very best, revealed more smoke and more mirrors.
Editors note: It is interesting to note that certain members for the elite in Glenville have access to high speed internet via the WVU Net that is connected to small LAN network out of Glenville State College, all of Charleston has high speed access, but residents of Calhoun County, and non elite members of Glenville have not one hope in hell of seeing a high speed connection and that is not likely to change.
Also citizens would see that many other inconveniences and sordid matters don’t exist in other places in the United States, if people got out of the area and explored other regions with better job prospects and much better and healthier living conditions – they would find better situations do exist, but not in Central WV still held under a totalitarian rule.

State Police in Calhoun have arrested a man who is using several aliases, charging him with multiple crimes from prostitution pimping and operation of a house of prostitution to filming a minor in a sexual act to sexual exploitation.
The man has been booked into Central Regional Jail under the name of James Robert Morsey, 37, but he has also been booked under other aliases, including James Hammond, Jamie Hammond, JB Jones, James R. Brick and James Harper. He is being held on $70,000 bond.
State Police are reportedly trying to sort out the man’s real identity, with sources indicating the man is originally from New York state, but had apparently been in southern Calhoun where he allegedly engaged with others in a sex operation.
He has also been charged with theft, transfer of stolen vehicle, and petit larceny.
State Police do not issue public information in Calhoun County, with information regarding the incident to be issued from Calhoun Magistrate Court or Calhoun Prosecutor Shannon Johnson.
Lets speak about the RAPES at GSC that have been purposely NOT brought forward by Gilmer Prosecutor. Rodney Smith was caught in the act of sexual assault and our prosecutor did not bring the case forward, and another rape just exposed by a local website was not brought forward when they had a confession, and then a Quarterback brought in from D.C. viciously raped a local girl everyone knew from GO MART Mary Hudnall, and she was threatened with rape again, if she showed, up to court. The Gilmer Prosecutor threatened Amanda Smith in a letter if she told about her rape, and now that rape complaint is in US District court. Megan Ruddlesden a local athlete was raped by ONEAL BLAKE at GSC football player and the rapes go on and on back to the days of Wilkie Perez who raped Anita Phillips Wiseman and our current prosecutor committed a FERPA violation to try to save the rapist and ruin the victim.
Gilmer Prosecutor did have to pay a 400 dollar fine, and had to admit to the office of the ODC that he was a liar and lied in his first letter and statement to them, and soon all of this may go national on the TV for all to see how wicked of a place it is at GSC!
Only then are we going to get action taken against the prosecutor for the state will be forced to take action, but for now all we can hope for is a federal indictment of some of the local law enforcement officers including Gilmer’s current prosecutor for misconduct.

There was no conviction Mr Harold Robbins, many have been arrested, so what! The charges are then not brought forward by Gilmer prosecutor on purpose and that particular rape I have the police report for and all the documents pertaining to that case, because we are preparing a complaint to made to high authorities and I have talked to one major network and got to argue the issues with their highest decision makers.
There have been no convictions for any rapes and one major network knows all about it, but dropped short of getting the OK to spend the 200,000 it would cost them to get their trucks here from New York with all their crew, but since then, Amanda Smith filed against GSC in federal court, and GSC recruited the “COCAINE QB” from a TOP TEN Football team the University of Michigan and that would be Justin Feagin.
Mary Hudnall was the victim of that rape by Gabe Prophet a QB of the football team. Mary Hudnall worked at Go-Mart and she worked hard in college, and now all that is ruined. She was threatened to be raped again if she showed up to court. There was no trespass charge, you are talking out your A*S HAROLD, which is typical for someone in Glenville that wants to change the whole story around.
I have all the reports and facts, obviously you have none.
NONE of the rapists have been convicted of anything because we have a prosecutor who does not want to tarnish the image of the school while GSC leads the state in RAPE and is last in academics.

The house of ill fame was a stolen van in which James Robert Hammond, 40, of Whitesboro NY, aka James Robert Morsey, was traveling.
He is in Central Regional Jail with bond set at $70,000.
Hammond, according to the criminal complaint, was pimping a 17-year-old female in southern Calhoun in a stolen van, with police discovering a photo of Hammond engaged in a sexual act on a cell phone they found in his parked vehicle at Minnora.
The complaint says during September, Hammond did let three other men, residents of the southern Calhoun area, have sexual contact with the minor in the back seat of the stolen Dodge Caravan.
The complaint says Hammond did receive money for pimping the minor, with one subject agreeing to “the right price” and paying $44 for oral sex and another subject paying $50 twice for oral sex, according to the complaint.
Police have yet to charge those individuals, having knowledge of their identity.
Linda Huff is OUT as fiduciary commissioner of the Willard Cottrill Estate and it looks like the state police may have stepped on their dicks by allowing people to move on to the property when the matter has not been settled, or resolved legally and the estate has not been finalized, and now with all the wrongdoing that fact WILL come out in the press, I doubt anybody will come close to a case where Gilmer County Sheriffs deputies stand accused of being accessories to murder.
