THE COTTRILL ESTATE DEBACLE IS STARTING TO UNRAVEL — TWO COURT DATES HAVE BEEN SET, ONE INVOLVING THE EXECUTOR OF THE COTTRILL ESTATE FILING A CIVIL ACTION AGAINST THE GILMER COUNTY COMMISSION. THE COMMISSION SEEMS TO BE ON A MISSION TO REVEAL THE WRONGDOING OF MICHAEL MURPHY THE EXECUTOR — AND FACTS MAY VERY WELL POINT TO A REASONABLE CONCLUSION THAT THERE WAS PLENTY OF MOTIVE FOR THE MURDER OF WILLARD COTTRILL — WHO DIED FROM AN OVERDOSE OF DRUGS — INCLUDING A DEADLY DOSE OF MORPHINE. HOWEVER THE LOCAL DOCTOR HILARY MILLER LIED ON THE DEATH CERTIFICATE REGARDING THE CAUSE OF DEATH, MOSTLY FOR THE REASON TO PROTECT HERSELF FROM THE CRIME THAT IT WAS DR MILLER THAT SUPPLIED THE DEADLY MORPHINE THAT KILLED WILLARD WITHOUT EVEN SEEING HER PATIENT TO SEE IF INDEED THAT DEADLY DRUG NEEDED TO BE ADMINISTERED.

This article is authored by the President of the Council of Concerned Citizens Dan Bingman whose family still has 155 acres of property in Gilmer County and a 365 acre farm in Wirt County

In this first document there is clear evidence that the THREE WOOD COUNTY bank accounts totaling over $125,000 recognized in the first accounting with one cd account worth $14,000 dollars were all cashed out by the executrix Rosa Belle Gainer against the express wishes of Albert J Woofter.  As, soon as ALBERT J WOOFTER was dead with the unsigned Power of Attorney paper work on the night stand as they were taking his lifeless body away, Gainer liquidated all the accounts and put it into one bank account where R TERRY BUTCHER her employer had control of the day to day actions. The amount deposited was $73, 352.50.

SO, we have a paper trail that proves that $125,000 was cashed out of three accounts, and only $73,352.50 was deposited in the bank in Glenville where R Terry Butcher is on the board. Another conflict of interest.

Evidence shows that there were three accounts with an excess of $125K and GAINER put it all in one account that the “Benny” only got seven thousand from after Gainer and the B& B Law firm pilfered the estate.

There was no accounting from 1994 until 31 Dec 2006 against WV LAW.  The Butcher and Butcher law firm broke the law and a call was placed to office of VANCE GOLDEN a commissioner in Wood County as to WHY he allowed Timothy B Butcher and R Terry Butcher to break the law and steal money from the estate.

For five years, lawyer after lawyer sent letters to Gainer and Butcher requesting their client have an accounting entitled by law, but the B& B law firm would not take calls and did not respond.

While doing the final accounting Tim Butcher paid himself as much as $10,480 per day, and those documents will be provided in a further publication and some of it has been published in the past, so a Google search may turn up some evidence.

Butcher wanted to make sure that when the account was settled the law firm had already used up the money that was in the bank account which was a situation certainly against the wishes of Albert J Woofter.

Margaret Kreiner, an attorney in Ohio wrote letter after letter stating that they were not adhering to the wishes of the deceased according to the will.  But, the Butchers obviously had Judge FACEMIRE and a few other WV Judges in their pocket, so why should they worry. Kreiner for two years wrote to Gainer asking that Butcher be fired as per wishes of Ruth Woofter and the Guardian. All these letters were ignored by Rosa Belle.

The second document is only shown to establish that according to their own paper work at the Butcher and Butcher law firm, the fact is and was that Rosa Bell Gainer IS NOT A RELATIVE – THEREFORE SHOULD NOT HAVE RECEIVED A PENNY IN THE DISTRIBUTION OF FUNDS FROM THE MISSING 1/6th.

Beverly Marks, the Gilmer County Clerk, distributed money to people RUTH WOOFTER had not seen or heard from in over 30 years and many like JACK GAINER the son of Rosa Belle Gainer and Rosa Belle herself were not even related, but money was sent to them anyway.

The GILMER COUNTY SHERIFF METZ not only ignored our documented complaint, but threatened to have me arrested if I were to investigate, “Any more of his people”

When an entire town and county is involved in this kind of crime that was protected by the local state police and Governor Manchin, now a US Senator, really how does one proceed?  Should we follow their lead and take the law into our own hands?

As to Item 7 BENEFICIARIES (SEE INSTRUCTIONS PAGE 13

The listed “Benny’s is for the AJ WOOFTER ESTATE and HAD NOTHING to do with the missing 1/6 of surface property that is on the Calhoun/Gilmer County line West of Glenville on highway 5.

It was clearly established by their own paper work from the Butcher & Butcher law firm thatROSA BELLE GAINER now known as Gainer – Cunningham was NOT a relative yet it wasGAINER that received CASH for the missing 1/6th and NOT the immediate family, that had been supporting Ruth Woofter and giving her a home to live in, plus paying for medical care and all taxes.

JACK GAINER, Rosa Belle Gainers son also received cash from the sale of the missing 6th and if Rosa Belle is not a relative, then her son is not either.

THE Missing 6th was not controlled by the estate and the guardian for Ruth Woofter lives in OHIO, and so did RUTH WOOFTER and NO DISTRIBUTION of her funds should have been made from the state of WV. Gilmer County was only supposed to approve the sale so she could use the money for medical help.

Tim Butcher and Beverly Marks both committed a crime with a witness present that will testify, when they disobeyed a court order to sell the property for much needed medical care and PULLED THE TITLE from the land books.

Sheriff Metz never had any intention of doing the right thing, instead attempted to cover the matter up with threats.

WHO MADE UP THE LIST OF PEOPLE TO RECEIVE MONEY FROM THE MISSING 1/6th hidden and pulled from the land books? Beverly Marks? If so, she should be immediately arrested, and the Sheriff should be removed from office.

THIS IS A CRIME not only ignored by the SHERIFF as if, the matter did not exist but also ignored by the WVSTATE POLICE TOO because the final decision maker, the chief counsel from the State Police is from Glenville and directly tied to IKE MORRIS!

These documents are all evidence of a cover up and Gainer and the Butcher and Butcher law firm STOLE money from honest citizens from out of state and did it with the help of Beverly Marks the County Commission Clerk and the GILMER COUNTY COMMISSION ORDERED IS HEREBY ORDERED TO PAY THE MONEY or be held accountable for being accessories to a crime and civil action with penalties.

Timothy B Butcher had no legal right to interfere with that title, but it also was needed in a WV SUPREME COURT CASE and the result was the complaint NO 178- 2011 filed against Justice Jean Davis who certainly has no explanation as to why only 5/6 of the property in dispute was moved forward from circuit court against the rules of legal procedure.

By this proof alone the family that was supposed to receive funds feels they have enough evidence to have MARKS arrested, but when the matter was brought before the state police they refused to press charges, so the matter went before the counsel for the State Police, Virginia Lanham, and now we have discovered her father was a personal attorney for IKE MORRIS Clearly there is corruption in Gilmer County and the clearly the State Police have acted in an irrational and illegal matter.

In fact the state police tried to press charges federal charges against me for making the complaint.

“When LAW ENFORCEMENT becomes a political entity like the WV State Police then AMERICA can no longer be AMERICA and this seems to be the situation for the state of West Virginia!”

Bill Grottendiecks daughter is Virginia Lanham who was the chief counsel for the state police when I filed my complaint with Major Ingold.

Bill Grottendiecks was IKE MORRIS’ number one attorney for over 20 years.

Lanham was the one that decided if my complaint over the missing 1/6th was accepted.

Major Ingold and Lanham more or less ignored the evidence on the recommendation by Lanham, but the virtue of the letter he wrote in response, all of the facts are wrong so by that evidence alone, their execution of the action, would on the surface appear malicious and in bad faith. But, that’s how they do things when it pertains to Gilmer County West Virginia, the POSTER CHILD for West Virginia’s legal hell!

So the title opinion, and back taxes has not been accepted as a complaint or even acknowledged, officially, by ANY agency in West Virginia, and Ohio law enforcement, and everyone else thinks that is pretty weird, but now that I know LANHAM the chief counsel for the State Police is Bill Grottendiecks daughter, it all makes a lot of sense.

Unfortunately the real criminal in this situation is the lawyer from Glenville representing State Police and some Gilmer County public officials   — And of course the County Commission Clerk Beverly Marks.

 

Marks was written a letter in July asking her to comply on the sudden reappearance of the missing 1/6th:

Beverly,

I spoke with Judge Spicers office today regarding the 1/6th of surface property inDekalb owned by Audrey Ruth Woofter my aunt, a piece of property I paid taxes on myself, since my mother has broken her hip and didn’t work. Ruth never worked or held a job and had no income.
I explained to the judge’s office that I had a witness that was present when you called Tim Butcher and asked him what to do. The witness said, that Butcher told you to not do anything with the court order from Spicer.

I am talking to an officer of the court by cell phone as I am writing this to you. Spicer is an old family legal name around here and the judge is retiring at the end of the month. We asked him to take action before he leaves office

You ignored the judge’s court order and my aunt did not get the medical treatment she needed because you shelved the court order on order from Butcher who was city attorney and had nothing to do with this case.

Since you shelved the court order and took no action, my aunt could not get the medical treatment she needed for she needed the money from the sale and she died in Ohio.

The judge’s secretary asked me to file charges in WV and I laughed until I nearly cried, for we tried that and got no response from Metz which they actually did not believe. It was an uncomfortable moment, but I assured them it was true.

I will be back in touch with the judge’s office tomorrow and will be talking to the judge after he is fully briefed to ask him what sort of action should be taken. He was not happy you ignored the order and Audrey Ruth Woofter died on Xmas day.

Also, you took it upon yourself to distribute the funds from the sale after the death to heirs Ruth had not seen in over 30 years or so much as sent her a Xmas card. I reviewed the will and this was not the wishes of Albert J Woofter.

Further, matters were clearly stated in the will.

I explained to all concerned of your connection with Timothy B Butcher who pilfered the estate, and we have a serious issue with that. We have a witness that stated you always conferred with Butcher as, “What to do!?“

What you did was not legal, and we have evidence of you having committed similar acts in the past.

If for some reason any of these facts are incorrect, and/or you dispute the testimony of an eye witness, then I suggest you cooperate fully with authorities. You may want to speak with an attorney, at this time.

I have the list of heirs along with the title opinion that was also absent from the courthouse records when requested. We will ask you how you came by that list, and also why you did not go by the wishes of the Albert J Woofter will which specifically stated that all assets were to go to Ramona Bingman.

Rosa Belle Gainer was not a relative to Audrey Ruth Woofter, but yet we noticed she received money illegally from your transaction. So did her son.

How did she get on your list of heirs? Where did you get the list did you just make it up, who helped you with this alleged criminal action?

Ramona Bingman was the registered legal guardian, and had been for years. This was proven to Butcher ten times over, and it is matter of record here at the courthouse, and clearly it was established as fact today.

You decided to, “Make up your own rules” down there in Glenville, and really isn’t that how you always do it!
And this is a PUBLIC NOTICE TO BEVERLY MARKS PROVIDED BY AN AMERICAN FREE PRESS

Beverly Marks, YOU are to contact me immediately in regard to the MISSING 1/6th which you had no right to sell. You were given an order to sell that property while RUTH WOOFTER was alive and you hid the title instead which is criminal. While waiting for the money from the sale for medical care, RUTH DIED ON CHRISTMAS DAY, and as far as I am concerned you are implicated in a wrongful death and so is everyone that helped you who includes Tim Butcher and Sheriff Metz who attempted to cover up the matter and refused to investigate the allegations.

I spent 15 hours on the paperwork dating back to 1994 recently. I spoke at length with my attorney, who was hired for that purpose of reviewing all the documents, and then he attempted to speak with the Butcher&Butcher Law firm on our behalf, but rarely got any response at all. And then,  when he sent proof of the affidavit that proved who the legal guardian was Dianna L Butcher LIED and said they never received the document, but being of above average intelligence sent the document signed return receipt requested, signed and dated by Dianna L Butcher which proves that she lied to our attorney and got caught.

“But, that’s how you always do it in Gilmer County!”

You need to call your attorney for we are going to be filing criminal charges against you and or bringing civil action in US District Court for compensation and also for punitive damages, unless of course Gilmer County wants to settle this suit. But, we know how they are from years of experience, extremely dishonest just like you Beverly Marks.

It clearly states in earlier paper work that Rosa Belle Gainer Cunningham is not a relative, yet you gave her the money from the sale of the property!

You got a court order to sell the property in 2005—but you did not sell it! You pulled the title from the land books like a common thief and you did it on order of Tim Butcher who had nothing to do with that property. What you did is a crime Beverly Marks and you are going to pay for it with as much jail time as we can possibly get you in an honest court, which certainly could never be a Gilmer County Court.

R Bingman was the legal guardian, and all the papers are in order. But YOU BLOCKED the sale until after RUTH DIED when it was her money, but then you abused your position as clerk and gave the money for the property that was not yours to some friends of yours. I would love to discuss this matter with you ASAP – so call me, everyone has my number. I want to see you face to face about this concern as soon as it can be arranged.

During the entire time the Butchers were in control of the AJ WOOFTER estate they pulled every dirty trick in the book and just sat back in their big leather chairs and weathered out the storm protected by Judge Facemire and the Elites, and kept saying they had no documentation that R Bingman was the legal guardian of RUTH WOOFTER and her primary care giver and her niece that supported her, and provided her with food clothing and shelter for as long as I can remember.

An attorney from Cleveland and licensed to practice in New York is also a federal attorney and could no longer take the stalling tactics of the Butchers, so for an hourly rate which was rather costly provided all the paper work AGAIN that the Butchers needed to prove who the legal guardian was.

This receipt is signed by Diana L Butcher, but then the estate was held up for almost an entire year after the date on the signed receipt because the Butcher and Butcher law firm said they never received the documents which everyone knew was a complete and total lie. The last day Butcher had control he took more than ten thousand dollars out of the cash account which was three thousand more than the actual beneficiary got and that is just plain a crime. Butcher took 38,000 dollars from the estate in FEE’s he never earned in the last 90 days.

Another attorney by the name of Roger Curry had to be hired at a cost of $10,000 dollars because Butcher refused to cooperate with the out of state attorney, as he did with the four previous attorneys hired.

Rosa Belle Gainer – Cunningham got more than the 3% allowed by law for being an executrix and in some states could have been jailed for being an employee of Butcher and Butcher while being the executrix also, and then just taking more than the 3% allowed. This is a clear conflict and we believe by proven documents that Gainer committed embezzlement and fraud along with Butcher and Butcher and they should be arrested.

All documents are on file at the office of Vance Golden or at my home office, if any person wants verification of facts, I will do all I can to see they get the documents for review.

Why are public officials in Glenville allowed to break the law?

Who believes that R Terry Butcher and Timothy Butcher should be placed under citizen’s arrest, and then immediately and escorted to jail for stealing money from an elderly mentally challenged person as Ruth Woofter.

Audrey Ruth Woofter was my aunt, and myself and my entire family loved her. I can remember her from the early days in WV since I was three years old. The actions in Gilmer County killed her as far as my family is concerned, but please review the facts and draw your own conclusion, and then let’s put these people in jail where they belong.

The first thing that brings a huge RED FLAG is the fact that Charles V Renner just allowed his secretary to make a transaction and a highly illegal one if I read this correctly.

That is not allowed.

For those from Wood County know Mr Renner never made it out of the hospital, and died right around the time of the document published in this article.

My Uncle was one of the Wood County Commissioners that signed off on the estate.

Anybody that is anybody from Glenville knows that the Butchers made their living by stealing from estates, and if heaven were to release some secrets, this sort of illegal procedure got by the right people time and time again in Gilmer County.

People in the know are aware that some of the money from this estate was supposedly donated to GSC, but it obviously was not theirs to donate.

I vote for immediate arrest,and I think it is time Sheriff Metz resigned. This is just on too many times he has been involved in criminal activity.

All estates B & B have been involved with should be identified and there should be a comprehensive investigation to determine if there was a history of estate pilfering. Also, this GFP posting should be reported to Rachael Cipoletti (rfcipoletti@wvodc.org ) at the Bar’s Office of Disciplinary Counsel(ODC)to observe how it deals with a complaint against lawyers. There probably would be a response that there is insufficient evidence, the statute of limitations has passed, misconduct did not rise to a level to merit discipline etc. Why have G. Hough and Metz failed to investigate the alleged crime? Does a citizen have to file charges before they are authorized to act or are they afraid to take on the Butcher’s? We need answers because this report relates to corruption in the County, and there is little wonder why citizens are afraid to take stands when there is evidence that the rich and powerful receive preferential treatment.

This article needs to be published in the Braxton paper.I have went through the same thing in Sutton court.Facemire should also be prosecuted if he did wrong in this.I had an attorney in Sutton that was dishonest,knew the other side ,went against me{my own attorney}because he did not want to go against other attorneys.This attorney has also practiced with Butchers.If you are honest in Braxton County court your in trouble.They go for the nasty,dishonest,thieves and liars.What a shame!!

Cipoletti proved herself to be as corrupt or more corrupt that the worst of the worst in Charleston by not accepting evidence against Gerald B Hough that proved criminal intent and no due diligence used. YOU are CORRECT she would have just made up an excuse and the best article written about such matters was written my our own PHD Carl Armour yesterday. It was right on point with the problems, please review that article.

This part of West Virginia is often recognized by well laid nests of crime clubs where bribery, extortion, nepotism and sleaze are ways of life. Local governments in West Virginia are today more often than not corrupt as all get out, but specifically Gilmer County – and we have well documented proof of corruption!

“That’s just the way we always do it in Gilmer County”

“What is the purpose of electing officials to run local government … of choosing leaders?”

If you have ever given this question some thought, the chances are you figured that they exist to serve us, but in Gilmer County an elite group has formed to serve themselves — and like minded affluent and are known locally as the Gilmer County Power Elite, or even better known as the Crooks from Crooked County that live down by the Crooked River!

The Secret Seven Coalition leaders in the FREE PRESS movement in Central WV are tackling ethics complaints from citizens involving public official’s almost daily and publishing weekly articles that often involve acts of misconduct in Gilmer County government or justice system which has a reputation for corruption, which also includes close political ties to Charleston. But mostly many of them have been pubic hair servants for all the sex scandals in Gilmer County that have become famous over the years!

We have a saying in the Central WV SS, “Penny for your thoughts,” for long time SS member Penny and “Bunny for your wiener” as long time SS member BUNNY and original Cal Patty Press chick since 2006 shows us how to suck  a Crooked County wiener in honor of the boyfriend of Crystal Metz Jeremy “Wagging his Wiener,” Wagner who was an adult in charge of the totally out of control high school STATE Tournament VOLLEY BALL event.

Glenville, the county seat of Gilmer County is now known for drugs and illicit, unethical, immoral debauchery that has made it to the pages of the Gilmer Free Press and these accounts are personal accounts of people that were there and/or Police reports!

In most places in America individuals clearly work for government because they are altruists, wanting to do what is best for everybody, regardless of their own self interest, of course,    ….but this isn’t America, this is West Virginia!

And more specifically CROOKED COUNTY where they murdered FRED HILL!!

Judge Richard A Facemire the Judge that has had the most reversals by the WV Supreme Court in the last couple of years,has even more misconduct complaints revealed soon and will have to make a decision to recuse himself when the motion is filed to bring the “Travesty of Justice” case back before the Gilmer County 14th district circuit court on the grounds that new evidence was discovered that proves Hough paid to have a state witness commit perjury involving ownership of property.

Well, it may be the devil or it may be the Lord of IKE, but you’re gonna have to serve somebody. You may be rich or poor, you may be blind or lame, and you may be living in Crooked County under another name. You may call me R Terry, or maybe just Jimmy West, or you may call me Lady Titans Coach Bobby Duvall and my mouth will be at your lil girls breast, but you got to serve somebody at the CHURCH of IKE!

Whistle-blowers can be framed for crimes they did not commit, or even come to experience foul play. Dissidents are carefully watched by the police, and may wind up in hot water for mere expressions of opinion. However, anything can go on at the home of IKE MORRIS (shown above)  …all you got to do is SERVE SOMEBODY!

Governments are basically businesses where large sums of money pass through every day, where licenses and permits are sought, where unwarranted criminal prosecutions often originate and where suspicious contracts and purchases are awarded.

“The temptation to steal in Gilmer County, to promote graft or to build corrupt little empires is pandemic!”

Those who seek political position in both county and city government often do so for the basest of motives.

Others, like those in Gilmer County have become enchanted with the concept of power, and become corrupted by its taste. Organized criminal networks flourish in the environment of local government, and often the line between criminal, government employee or official is blurred.

“With the recent outcry for help involving the misconduct in the Gilmer County Sheriffs office and Deputy Jones using a Taser weapon on a citizen, we wonder how many members of law enforcement have a criminal history or other blemishes on their record.”

Are they accepting bribes from the owner of a local towing company like we have been a hearing?

An inquiry into this might include officials of both city and county government and there will be no answers forthcoming.

“It really is not what you know but who you know in order to do business in Gilmer County West Virginia!”

Speaking of SCANDAL and sexual misconduct involving the Gilmer County Sheriffs office and even the daughter of the head law man here in the town of Glenville, the latest involves drunken fun at the Gilmer County High School Volley Ball tournament.

Former Wirt County High School math teacher and girls’ basketball coach Lijiah Heiney, 36, was arrested and charged with six felony counts of sexual abuse by a person of trust stemming from an alleged inappropriate relationship with a student. Each offense carries a 10-20 year prison sentence, as well as a fine of $500 to $5,000. Heiney was reportedly Mirandized and confessed to the incidents.
According to the criminal complaint filed in Wirt County Magistrate Court last week, Heiney engaged in numerous acts of “willing sexual intercourse” with a 16-year-old female student. The relationship allegedly began at the high school and then carried over to Heiney’s residence in Elizabeth. Investigators say that Heiney engaged in sexual relations with the teen beginning in May and continuing through July 4.

Don’t be fooled, Gilmer County had no more say in the takeover of its schools than it does in bringing back its 911 center. Having a say would mean the public had a voice that was heard with consideration given to it.  That does not happen in Gilmer County , West Virginia.  Never!

Gilmer Schools Coalition needs your support! State appointed Superintendent Ron Blankenship will not answer any questions or cooperate with the local press about informing the county and school district about progress involving relieving ourselves from the forced takeover by the state, and the public wants to know! Matters have only become worse since the first week of June 2011. 

There are three basic reasons for school intervention.  Poor educational stats, all Gilmer County schools made AYP and a system gets six months probation to submit a plan to fix the problem before that happens.  Failing financially, Gilmer County was in the black and again the system gets a six month period to submit a plan to correct that.  No, Gilmer County got what was behind door number three… a takeover based on an emergency affecting the health and safety of the students.  The only instance demanding immediate takeover of a school system. 

But, if that was the case, WHY IS EVERY GILMER COUNTY CHILD STILL SITTING IN THE SAME SCHOOL BUILDING THEY WERE IN OVER TWO YEARS AGO WHEN THE STATE TOOK OVER THEIR ELEMENTARY SCHOOLS? What was the emergency?

The only emergency was political and the immediate protection of Principal Butcher’s job and who you gonna’ call?

The only person left who would do that with pleasure, retired, released in the past as Gilmer County Superintendent  Ron Blankenship – And with a political axe to grind since Gilmer failed to put him in the House of Delegates.

For some reason Blankenship feels that a totalitarian situation does exist, and that even in America we have no right to information, and that since he is connected to the big crooks in Charleston, that he can just do and say what ever the fuck he wants to. Which, indeed, makes these meetings obsolete, and they serve no purpose other than to say, you can’t get any answers to any of your questions, and these school board members feel they have no one to answer to.

Ron Blankenship is the very man who will do what he’s told for a dollar sign and give jobs to those who donated to his political campaign with no thought to their qualifications or the good of Gilmer County students and their families. The man under strict orders to protect Principal Nasia Butcher at all cost, answers no questions and whose only response to drugs, bullying or any other problem in the only problem school Gilmer County has is “we expel them every semester in Calhoun County .”

The common citizen has no say in Gilmer County and every elected official you put in office save one  says not one word in your defense.  It is absolutely no different than what will be done with your one million dollar debt for a 911 center you don’t own. It’s no different than elections that keep repeatedly having to be decided at canvas. 

Keep putting them in office people …oh yeah that’s really working!

This is the kind of treatment you can expect.  It will not stop.  So take it or change it, it’s up to you. Why not take hold of the reins and get involved yourself and be a part of a change for the better! Stand up! Stand up and BE the CHANGE! Speak out!

Here is the report on the court case according to a Free Press update:

Monday, February 27, 2012, the Gilmer County Circuit Judge Richard (Dick) Facemire dismissed with prejudice the lawsuit filed by the Gilmer County Prosecutor Gerry Hough on behalf of Gilmer County Commission, and Jean Butcher, the Gilmer County Clerk against Lawrence Smith from the WV Record.

The lawsuit was filed because Smith had requested information under FOIA.

Decision was made by the Judge after Gerry Hough and Lawrence Smith made their presentation to the court.

The decision by the Judge means that the lawsuit may not be re-filed, and as such, it operates as an adjudication on the merits.

Smith defeated Hough in the Gerald B Hough home court and the prosecuting attorney even made it a point to tell the judge that Smith had been friends with and knew the Supreme Commander of the SS.

12-12-12 there was another sexual assault in the dorms at Glenville State College, usually alcohol and drugs have seemed to play a major role in the numerous sexual assaults and alleged rapes at GSC. So far there have been no convictions and the latest victims of sexual assault at the college all say that NO FEMALE is safe at Glenville State College.

Judge Richard A Facemire made no reply to the off the cuff, Hough comment of who it is Mr Smith knows, but must have been thinking to himself…

“Man oh man this Gerry Hough is an idiot as really to what purpose does making that statement have to do with this court case!”

“This time the problem, and illegal procedures didn’t go away … this time LAWRENCE SMITH won the day!”

“All three commissioners and Jean Butcher were there by subpoena and were told, don’t worry, this one is in the bag!”

As is Prosecutor Hough’s habit, he starts out smooth, cool and proper, but when he feels the tide turning toward the defense he starts whining and saying but your Honor, look at the law, you can do sanctions! This guy is best friends with someone else who says this county is Crooked and ran by Crooked County Crooks!  I hate that guy!  Make this guy pay for it!

 Look at these poor Commissioners, how they have been maligned  –as the Commission stares at one another wondering why in the world they were even there!

The position of Gilmer County Prosecutor is the same position of government which should be protecting the best interests of the people whose taxes pay him two salaries for two jobs.  It has yet to be proven Hough does either well.   As it came to pass, Judge Facemire wasn’t going there and rightfully so.   It is a wise man who won’t let Hough stick him to that TAR BABY!  For that day, for that case, justice held for the rights of the citizen and we have Lawrence Smith, brave and capable to thank!

We could go on with the Sheriff’s lack of ethics forever, and then forever and a day, for we have the most CROOKED SHERIFF in the entire state of West Virginia, why do you think they call Gilmer County … Crooked County, because Sheriff Metz goes along with every Crooked deal the Crooked County Crooks present him with. Metz looks the other way for RAPE and MURDER and that is the specialty of Sheriff Metz! Hell the dumb ass might even store a dead body or two for ya, if you have enough money or promise to get him elected to the office of magistrate by HOOK or CROOK.

 You know for a FACT the fraudulent diploma presented pretty much says it all — from day one of Mickey Metz showing up on the Scene — As history will someday show that METZ was a fake from the start!

MURDER Crooked County style is what we all saw again, as allegations of coverups and more involvement by the Gilmer County Sheriff Mickey Metz known as a puppet for the Power Elite and Gerald B Hough head law man for Gilmer County both took active roles in making sure that the wrongful death of Willard Cottrill was NOT LOOKED into, and that no questions be answered since the matter has been under investigation for two years. Many have reported they believe both Sheriff Metz and Gerald B Hough have accepted money to see that the truth of the matter,the fact that Willard Cottrill was murdered is covered up !!

“Family members of Willard Cottrill allege he was murdered with drugs being administered against his will and in front of a witness, who was a live-in companion by the name of Ruth Mitchell !!”

A family member called Gerry Hough Gilmer County Prosecutor the night after Willard Cottrill died and after she got to her father Willards house. The daughter, Marlea Cottrill noticed the house had been looted just hours after he fathers death.  Gerald B Hough was called and told that there was something very wrong, but yet, Hough did nothing…

Ruth Mitchell Screamed, “You can’t do this!” Huffman replied, “There is nothing you can do about it,” and then proceeded to talk to Ruth Mitchell worse than he would a stray dog! NO PERMISSION WAS GIVEN FOR THE SEARCH BUT THAT IS HOW THEY DO IT DOWN IN GILMER COUNTY!! The SS is currently seeking a meeting with HUFFMAN and deputy Wheeler about the incident, but we heard the matter was cleared by Mickey Metz himself, so no surprise there!

It is AWFULLY hard to keep trying to forgive, after you digest this tale of murder, and killing in the name of money and property in Crooked County.

I want to, but until the truth is finally told how can a person forgive anyone, or anything for the misery brought by Gerry Hough once again the persecuting attorney for Gilmer County!

Sheriff METZ and the local Sheriffs office are once again neck deep in a murder that they assisted. And once again, it is a disturbing murder as blatant as the FRED HILL no foul play display of debauchery and misconduct!

My associates and fellow members of the SS and the CCC are 99.9% sure that Hough was bought off because I KNOW for a fact from the mouth of Sally Bozeat the attorney mother of Sister Morphine, that she had some time previously they had talked to that crook Gerry Hough about the Will.

Bozeat didn’t mean to tell me, but OH WELL,  and I can’t remember what we were talking about right then, but she quickly trailed off because I think she said more than she wanted me to know, when she discovered the drool running down my chin that must certainly be connected in some way to our then discovery, through her own words,that evidence now existed that Gerry Hough – the biggest Crook in Crooked County – was involved in another cover up!

Hough being involved in more criminal activity makes us salivate worse than mad dogs! OH NO attorney Bozeat was tricked by the Central West Virginia SS! Bozeat will say they must have taped me!

But  family members of Willard Cottrill remember clearly because of the last name, HOUGH and that they heard he was going to have it rough all of 2012!! And also, that Hough is such an easy name to remember because it has the same number of letters as CROOK.

The more a Cottrill family member reminded Hough about that particular  conversation with Bozeat, the more evasive he got and within a few days, nobody was going to do anything, about another Murder in Gilmer County .. and so it goes!

The Central WV SS was stunned once the 28 days of gathering facts were over.  How do you NOT investigate a MURDER when we had so much background and evidence of wrong doing including the looting of all Willard Cottrill’s  property before he was even buried – let alone before ANY Will was read.

And then there is the fact that Willard was not properly embalmed – A daughter of Cottrill asked for an autopsy but Deputy Wheeler told her he had talked to T Ellyson the local funeral director the night after Willard died and Ellyson laughed and said “You don’t know what you’re asking.” It was just after there had been a mysterious fire at the funeral home, during the Fire Starting Cult hay days 0f 2010, and Ellyson wanted to save some money with the excuse, he didn’t have access to all of his tools and equipment so made some short cuts especially for Willard Cottrill who paid the full price and paid with his life.

“I’m pretty sure if someone talks to Dr Hillary Miller, she won’t deny it! What she did that is, the fact that she was actually and integral part of a planned murder for money, for you can’t really do a proper killing without the proper drugs!”

Dr Miller of Glenville, West Virginia did her part over the phone making it more than convenient for all those involved in the plan, especially since she never saw the patient to make the diagnosis that he needed such a strong pain medication!

“Venita Sister Morphine crushed up various meds including oxycodone, xanax in a spoon, poured morphine over it and added a glob of pudding on top.  When Willard Cottrill kept his mouth closed and refused it,  Freda Cottrill (Melvins wife) held his head while Sweet Sister Morphine shoved the spoon in his mouth.  Approx. 5-6 hours later he was dead. Sweet Sister Morphine picked up Willards lock-box, with thousands in CASH and all his important papers and left immediately after leaving poor Ruth Mitchell (Willard’s companion) to sit there by herself in the room where they just killed the man she loved more than anything in the world!

Dr. Miller apparently called in the prescription for Morphine to the Gil Co pharmacy — Dr. Miller later said she was lied to!

“Dr Hillary Miller of Glenville was scared when questioned, but said she was lied to by Venita – Sister Morphine, and that she was sorry that Willard was dead!”

Even so, that still does not mean DR DEATH, Dr Miller was not guilty as hell of conspiracy to commit a heinous crimes with others, and several of those others came from out of state to forcefully deliver a powerful drug to a helpless man, and there was a witness… Ruth Mitchell the long time companion of the dead man.  Ruth witnessed the killing and explained it word for word recently to a high ranking member of the SS, and then it was shared with the CCC.

“The prescription was picked up 10/20/10. The killers get the morphine and hours later Willard Cottrill is dead!”

As witnessed by the above information and photos 2012 in Gilmer County was still knee deep in covering up the murder of Willard Cottrill just like they are still covering up the murder of Fred Hill!

Gilmer County High School kids learn to drink at a very early age, and this behavior is even condoned by the Gilmer County High School Principal Nasia Butcher who has even drank with students and it as been claimed the Principal Butcher even drank with students at the school.

Sheriff Mickey Metz was found not to be qualified as a coach of the Volley Ball team at Gilmer County High School because METZ LIED about having a GED as credentials !! Sheriff Metz was finally caught when he filed a FAKE HIGH SCHOOL DIPLOMA bought and paid for by a company named ADISON with no accreditation, but METZ LIED about the accreditation in an article published by a Parkersburg newspaper !

Metz, who served his second term as sheriff in 2012, said he was in full compliance with the requirements for a candidate for magistrate, but Metz lied, it was proved he lied and the Secretary of State Natalie Tennant didn’t do a god damn thing about it because she is crooked too!

This is the FAKE High School Diploma of Sheriff Metz that has NO VALUE and is not accredited anywhere, and Metz lied to the press and a Parkersburg newspaper about this document.

“My credentials have been sent to state department and looked at by attorneys and are well within compliance with West Virginia Code,” Metz said, but METZ lied through his teeth, and Adison has been found to be completely fraudulent, yet Metz has had to pay no consequence yet so far.

West Virginia Secretary of State spokesman Jake Glance said he could neither confirm nor deny an investigation into Metz’s qualifications. Generally speaking, Glance said investigations become public through an indictment.

“Remember that we do not have arrest powers or prosecutorial powers,” he stated in an email, which was complete and total bullshit on the part of Jake Glance, they always say some stupid crap like that when they are caught covering for the misconduct of a public official!!

We conduct an investigation and then hand those findings off to a prosecuting attorney,” was what that dumb bitch Glance said later, and that is the generalized excuse they use when they know they already have a dishonest prosecutor in place like Gerald B Hough.

CLARKSBURG – A former Glenville State College student is alleging campus police failed to properly investigate her claim she was raped two years ago following an impromptu party in her dormitory.

The College, and Daniel Bell, chief of its public safety department, are named as co-defendants in a civil rights suit filed by Amanda Smith. In her complaint filed Sept. 17 in U.S. District Court, Smith, 21, of Mineral Wells, says campus police not only failed to conduct the most routine of investigation into her allegation she was sexually assaulted by a fellow student in 2010, but also lost important evidence.

The Central West Virginia Secret Seven Coalition has been reporting the rapes at GSC since 2006, over six years now, but the local print media has ignored these horrible crimes. The Glenville Democrat has been in on the cover ups all along, for they are a bullshit propaganda machine for the Church of IKE and are inept journalists that are about as unprofessional and unskilled at journalism as they come.The saddest part of this situation is that Dave Corcoran the publisher of the Glenville Democrap and Pathfinder of BULLSHIT is the President of the Press association for the whole state of West Virginia!

Additionally, Smith alleges hers is not the first time either campus police or GSC officials have showed deliberate indifference toward alleged rape victims.

A not-so-quiet evening

According to her suit, Smith, then a sophomore, after returning to her room in Goodwin Hall from her on-campus job on Sept. 18, 2010, received a text message from Michael McHenry, a fellow student, asking if she wanted to go out for ice cream. About that same time, Jayde Layne, another student, knocked on Smith’s door requesting help in the dorm’s laundry room.

However, Layne agreed to join Smith and McHenry for ice cream. They were accompanied by Jordan “Opie” Watkins, Erietta Patrianakos, and several “unidentified students.”

After returning to Goodwin Hall between 5:30 and 6 p.m., Smith alleges Layne, and another student, Kala Fisher, asked if she would get McHenry to buy them alcohol. When Smith declined, Fisher and Layne then asked Patrianakos who agreed.

According to the suit, Patrianakos then took the alcohol to Watkins’ room, and left to be with her boyfriend. Shortly thereafter, Smith joined other students including Layne in Watkins’ room.

About 8:30 p.m., Smith says she left to help her roommate carry groceries to their room on the second floor. Upon returning to Watkins’ room, Smith found additional students present including “unknown black males mixing drinks.”

Later around 9 p.m. Smith says Layne, who’d previously been mixing drinks in the bathroom, offered her a plastic cup. After consuming the unspecified contents of half of it, Layne brought her a different cup.

Sometime between then and 10 p.m., the suit maintains Smith appeared she was having a “mild seizure” after becoming nauseous “with alternating bouts of vomiting and urinating, crying and screaming.” Sometime thereafter she became unconscious.

According to the suit, someone removed Smith’s clothes leaving her in only her bra and panties. Upon discovering her disrobed and unconscious, Layne, Patrianakos and Fisher put Smith in the shower.

Sometime after 10 p.m., Andrew Lewis, Goodwin Hall’s resident director, heard Smith screaming, and went to Watkins’ room to investigate. After arriving, he was joined by Travis Nesbitt, a student in an adjoining room, in rending first aid to Smith.

At 10:09 p.m., Lewis called campus police requesting medical assistance for Smith. Twelve minutes later, Officer William Boone called for an ambulance.

An ambulance arrived at an unspecified time to take Smith to Stonewall Jackson Memorial Hospital in Weston. According to the suit, Nesbitt accompanied Smith, and observed her “holding her hands between her legs, stating “‘it hurts.’”

Upon arrival at SJMH, Smith was placed in the intensive care unit. An initial examination of Smith discovered “a bodily fluid ‘pouring out’ of [her] vagina that ‘was not supposed to be there together with bruising on [her] thigh and arm.”

A toxicology report revealed Smith had a blood alcohol content of .236, and the presence of benzodiazepine in her system. In her suit, Smith avers she was not taking any medication containing benzodiazepine, and only consumed half of the drink Layne gave her.

Grain alcohol and date rape drugs found a way on to the campus of Glenville State College and Amanda Smith was rendered helpless with alcohol and date rape drugs after being set up by two other female GSC students. Smith was an honor student and brutally raped and has filed a federal law suit against Glenville State College in 2012

Because she did not regain full consciousness until sometime the next morning, a sexual assault examination was performed in Smith later that afternoon. The examination revealed, among other things, bruising on Smith’s left shin, knee, upper arm and hip.

Also, the examination discovered Smith had “a large amount of mucus/discharge from her vagina that was ‘white/yellow’ in color in spite of the negative findings of vaginitas and the appearance of bacteria in her vagina opening.” Furthermore, a nurse told Smith’s mother “‘This should not be there,’” when showing her a swab of the substance removed from Smith’s vagina.

Evidence lost

The suit accuses GSC officials, specifically Bell, of “failing to follow protocol routine in sexual assault cases.” This includes the “lack of safeguarding and storing of evidence [and] properly securing a crime scene.”

According to the suit, campus police failed to collect both the bed sheets in Watkins’ room and the clothes he used to dress Smith after she threw-up on herself before they were laundered. Also, the cups used to mix and serve the drinks were destroyed before they could be collected.

Additionally, the suit alleges an investigatory notebook kept by Bell was “accidently placed in a washing machine and destroyed.” Furthermore, Bell “showed minimal training” when he accused Smith of “placing the bruises found on her body herself.”

According to the suit, the inability of campus police to timely collect evidence was a result of no certified law enforcement officer being on duty at the time Lewis called them for help. The investigation did not begin until Glenville Police Sgt. Casey Jones arrived at a time not specified.

Any investigation into who might have raped Smith was hindered by Layne, Watkins, Patrianakos and Fisher refusing to cooperate with police. According to the suit, they “have refused to identify students in the room and have changed their statements.”

Following her alleged attack, Smith says she attempted to complete her classes that semester. However, due to harassment by Layne, Fisher, Watkins, Patrianakos and other students, who are named as co-defendants in the suit, Smith says she found not only attending classes, but also living in Goodwin Hall difficult.

Assurances college administrators made to “implement reasonable accommodations” for her to finish her classes, Smith said, where not kept. After receiving a letter dated Oct. 7, 2010 from the College’s provost that she would most likely receive failing grades in her classes, Smith decided to withdraw.

According to her suit, college officials continued to display insensitivity toward her after she withdrew. Bell, Lewis and Jerry Burkhammer II, the dean of student affairs, were all no-shows for a meeting with Smith and her parents when she returned to campus to retrieve some personal belongings from her dorm room.

In the two years since she was attacked, Smith says there have been other sexual assaults take place on campus. Though she does not provide specifics, Smith says due to “a lack of investigatory technique and result” similar to what happened in her case, the other women “are considering filing separate claims against [GSC].”

As a result of her attack, the failure of campus police to properly investigate it and the harassment she received afterwards, Smith alleges she’s suffered “severe and permanent psychological damage, emotional distress and decreased educational opportunities.” Along with ones for civil rights violations, she makes claims for failure to train, retaliation, assault and battery and intentional infliction of emotional distress.

Smith seeks unspecified damages, interest, court costs and attorneys fees. She is representing herself.

The case is assigned to Judge Irene M. Keeley.
