Hough has attempted to publish false information that is not backed up by any court documents, in fact actually contains information that is not in any court documents because Hough published the exact opposite of the truth, and now may be in some trouble for it, especially since documents are being prepared to bring civil actions against him for filing false court documents while trying to keep the Gilmer Free Press under a gag order and Hough just lost one court action and now is being sued for court costs and attorney fees! Gerry Hough may not have long now before he is completely ruined professionally and he is so dishonest that Gerry Hough SHOULD NOT be teaching at any level, but especially college considering he has a FERPA CONVICTION! Hough is a documented liar and had to sign papers saying he admitted the lies he told the ODC when they investigated him for wrongdoing.

Gilmer County Sheriff Gerwig by the proof of court documents did commit Perjury, also known as forswearing, which is the willful act of swearing a false oath or of falsifying an affirmation to tell the truth, whether spoken or in writing during the Travesty of Justice trial by saying that Roanna Rafferty owned land the defendants family owned, so he bald faced lied and then conspired with Gerry Hough to hide the deed to cover for the lie to the courts, Gerwig also lied on the stand about the value of the farm equipment saying it had the same value as it did 25 years prior to the court case and judge Facemire allowed all of this because not only was he in on it, he was in partnership with Gerald B Hough to bring this false case for the fact he was mad about what was being written on the Crooked County Crooks website. Gerwig could be the next public official laughed at my 22 million Americans on FOX NEWS the same way AMERICA was shocked by the actions of Judge “Chip” Watkins who was taken down by the Central West Virginia Secret Seven Coalition.

There is a special place in HELL for someone like Marilyn Matheny of LEMON FARM EQUIPMENT in Parkersburg that would lie on the stand as a favor for Gerald B Hough. When the public was exposed to the secret audio tape made in secret that proved Matheny lied, the public was outraged and ask for her arrest, here is just one comment about that from the Gilmer Free Press — I would like to have an update on this case. What’s going on with Ms. Matheny and Mr. Hough? Is a court date set for their perjuries?

Now after listening to the tape you can see that Marilyn Matheny lied about the value for Gerald B Hough and they should both be in prison and we are not going to stop submitting these documents until they both have been arrested and put away, and further, they are continually protected by corrupt public officials like Rachael Cipoletti who protects corrupt defense attorneys like F JOHN OSHOWAY from Grantsville, for the experts say Oshoway gave up his client to do a favor for Judge Facemire and Gerry Hough and punishment for that wrongdoing may eventually find old F JOHN.
When the matter went to West Virginia Supreme Court Justice Albright and Justice Starcher felt F John OSHOWAY should have been sued for ineffective assistance of counsel.

I respectfully dissent from the opinion of the majority of this Court. Indeed, as the majority recognizes, this Court’s decision in State v. Boyd, 209 W.Va. 90, 543 S.E.2d 647 (2000), specifically governs this case. However, in my judgment, Boyd is unabashedly wrong
If a represented defendant pleads guilty to a time barred offense and thereby forfeits the statute of limitations, but later claims counsel was ineffective, on what basis could a court deny relief? Suppose the defendant requests and receives an instruction of a time barred lesser offense and is convicted of the lesser offense. Later he files a petition for writ of habeas corpus, claiming his attorney never discussed the statute of limitations with him, and if he had known the lesser offense was time-barred, he would never have agreed to requesting the instruction. When the record is silent, the claim would be credible. It would have to be litigated and would often be found meritorious. On the other hand, a simple waiver on the record would settle the matter.
I therefore respectfully dissent from the application of the Boyd rule in this case, and I would reverse the Appellant’s conviction.
I am authorized to state that Justice Starcher joins in this dissenting opinion.
Justice Starcher and Albright were right then and right now, and now the matter is going to be litigated .
Lets read from the court record and you can see for yourself the dishonesty of HOUGH, FACEMIRE and GERWIG who joined in a conspiracy to send an innocent man to prison for thirty years for telling the truth about Gilmer County on his internet website articles.
Please read the following document from the actual court record back when the very honest attorney Bill Martin was presiding over the case, these documents show that Gilmer County wasted countless thousands of local dollars on a false case based on a false charge and Facemire Hough and Gerwig should all be prepared to be held accountable by a federal authority and a pissed off public that now knows the truth!
Above, attorney Martin has evidence the judge broke the rules and asks FACEMIRE to disqualify himself, the mad midget Facemire declined, but Judge Richard A Facemire may soon find out that he should have disqualified himself because his lies have caught up to him years later, just like judge “Chip” Watkins and the result may be the same for Facemire.
GERWIG LIED on the first indictment and 2nd indictment giving the same value you see him give when he lied in court on the above PDF file, well the result of that lie is the defendant never made it to his brand new radio show, and all these documents prove that GERWIG is GUILTY of Conspiracy with along with Judge Facemire and Hough!!

You can see by the above document that JUDGE FACEMIRE LIED about reading a letter and should have been immediately disqualified, but has received protection from a very corrupt Judicial Investigation Commission whose only redeeming quality is that they accepted the SS complaints against Judge Watkins, and then the HEARING BOARD which is separate from the JIC, suspended “Chip” without pay and now we will be asking that judge FACEMIRE be suspended for lying about statements made to the defendant erased from the court record by Kelly White on the order of Judge Facemire and other illegal actions communicated above in the official court record from the Travesty of Justice case, the complaint that was filed against Facemire will be published below.
You can see by the above document above that we now forward to pertinent parts of the court record that result in the Travesty case being dismissed the first time at great expense to the state because Hough and Facemire are both dishonest and cost the county thousands this day and eventually the state would spend nearly 750,000.00 fighting the defendant for several more years after the below day in court.
You can see by the above document that an illegal procedure sponsored by Gerry Hough was allowed to take place and if this case was not dismissed this day it should have been defeated in appeal for the reasons of the illegal actions by Facemire and Hough and now the court released this sealed file to Christopher Todd Smith who agreed to testify in federal court that the courts handed the sealed file to him saying they hated Dan Bingman and that the documents were given to him by an elected public official. This information is being turned over to federal authorities next month in a meeting taking place in another state.
Bar Disciplinary proceedings in West Virginia under the leadership of Rachael Fletcher Cipoletti are essentially sham proceedings designed to protect attorneys from the clients they may have wronged – And clearly when you watch the video of the Watkins Hearing you will see it appears to any reasonable person that Cipoletti is attempting to protect the judge from punishment more than prosecute him for wrongdoing. The JIC Board went against Cipoletti and any recommendation she offered to get the judge off for his heinous action
You can see by the above document that due to Hough bungling the case it had to be dismissed at great expense and Gerry was so mad about it he made some shit up and Facemire was dimwitted enough to go along with it, which could prove to be a move that eventually destroys his career once exposed on a national news station.
Below find the complaint filed with the Judicial Investigation Commission against Judge Facemire and note we cant’ reveal the real damaging evidence we have against Facemire because it is an audio tape made when he did not know he was being taped and he already lied to the courts about what he said, but we have it on audio file and we are saving it to embarrass the judge in front of millions as well as expose the JIC for being a SHAM operation.
Cipoletti shown in the photo to the left was chosen by the Judicial Investigation Commission to preside as prosecuting counsel in the hearing against Judge “Chip” Watkins, but if you watch the actual video of the hearing posted on this website you will see that Cipoletti choked through the first part of the presentation and was acting more like a defense counsel than the lawyer representing the Judicial Investigation Commission, and Cipoletti was trying to get Judge Watkins off on a suspended sentence that would have resulted in no punishment at all, but the hearing board saw the writing on the wall with the number of pissed off journalists milling about and decided to throw the book at the judge so that they would not be the next attorney from WV embarrassed by FOX NEWS and Megyn Kelly.
I firmly believe Judge Richard Facemire committed serious misconduct during my hearings and trial and he took it upon himself to make his own rules regarding proper court procedure is how the document in complaint against a corrupt Crooked County judge was summed up along with a notary signature verifying the veracity of said document.

Over 30 complaints have been filed against F JOHN OSHOWAY with the office of disciplinary counsel but Rachael Cippoletti the head counsel at the ODC in Charleston has taken no action and made no sanctions against Oshoway who all the experts say not only did a piss poor job as defense counsel, during the “Travesty” case but the Supreme Court Justices said he was guilty of ineffective assistance of counsel and he should be liable to his client for damages. The damages for this case are over 700,000.00 bucks. Oshoway suppressed key evidence (secret audio tape)that could have cleared his client and clued in the jury about the scam that was pulled off, but Oshoway didn’t- convincing many he is actually guilty of a crime and should be held accountable for it.

John OSHOWAY wanted to play JUDGE and JURY when he bungled the Travesty of Justice case by never telling the defendant he was waiving his rights of statute of limitation which Justice Starcher and West Virginia Supreme Court Justice Albright said F John Oshoway should have faced civil action for the infraction and still may! When you combine that mal practice criminal act with the fact OSHOWAY suppressed the tape that clearly shows Marilyn Matheny was a state witness paid to LIE just like ROANNA RAFFERTY was who also was paid hundreds of dollars to travel from FLORIDA and testify that she owned 1/6 of the farm in question when, later, after the jury was lied to it was discovered Roanna Rafferty did not own ANY property at all that was part of the farm in the court case. Hough paid her to lie, and Sheriff Gerwig, a deputy at the time lied and said Roanna Rafferty did own property. So you can easily see how Gilmer County earned its name of CROOKED COUNTY and all these players will forever more be known as “Crooked County Crooks!”

Facemire ordered the defendant do a year in jail, but he switched the court order and suspended the sentence, but did not tell the defendant, SO THE DEFENDANT WAS SENT to Jail BY THE JUDGE — FACEMIRE as part of the Criminal Conspiracy told NO ONE he ordered the sentence suspended — But the clerk did send the document to John Oshoway and Oshoway never said a damn word about it.
Now that is almost about the most corrupt a lawyer and a court could get and that is typical Gilmer County, West Virginia.
